Welcome to FastEmail! These Terms of Service ("Terms") enable us to provide you with the services available at fastemail.net ("Site") and related services ("Services"). By accessing or using the Services, you agree to be bound by these Terms.
By using our Services, you agree to look to this Agreement for the terms and conditions of your relationship with FastEmail. If you do not agree to all the terms and conditions of this Agreement, you must not use or access the Services.
You must be at least 13 years old to use the Services. If you are under 18, you represent that you have your parent or guardian's permission to use the Services.
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account. FastEmail is not liable for any loss or damage arising from your failure to protect your password.
You agree not to misuse the FastEmail services. You must not:
Violation of this AUP may result in immediate suspension or termination of your account without refund.
FastEmail offers both free and paid plans. Paid plans are billed in advance on a recurring monthly or annual basis. You agree to pay the fees applicable to your subscription plan.
We offer a 14-day money-back guarantee for new subscriptions. If you are not satisfied with the Service for any reason, you may request a full refund within 14 days of your initial purchase. After this period, fees are non-refundable.
The Service and its original content, features, and functionality are and will remain the exclusive property of FastEmail and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of FastEmail.
You retain ownership of any content you submit, post, or display on or through the Service ("User Content").
We strive to keep the Service available 24/7/365, but we cannot guarantee uninterrupted access. For Enterprise customers, we offer a Service Level Agreement (SLA) guaranteeing 99.9% uptime. In the event of downtime exceeding this threshold, you may be eligible for service credits.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FASTEMAIL, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; AND (IV) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
Any dispute related to this Agreement or the Services shall be governed by the laws of the State of California, without regard to its conflict of law principles. You agree to resolve any claim, cause of action or dispute you have with us arising out of or relating to these Terms or the Services exclusively in the state or federal courts located in San Francisco County, California.
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
